1. What DRAYELD provides
DRAYELD sells an electronic logging device (the "device") and a subscription software service (the "service"). The service includes an electronic logbook with hours-of-service records and clocks, GPS fleet monitoring, IFTA mileage reporting, DVIR and maintenance tools, asset and sensor tracking, a driver mobile app and a fleet web dashboard. Together, they're built to meet the technical requirements of the FMCSA's ELD rule.
DRAYELD is a tool, not a substitute for compliance. The motor carrier and the driver remain responsible at all times for complying with applicable regulations — including hours-of-service limits — and for the accuracy, review and certification of records of duty status. We record what the truck and the driver tell us; making sure it's true, complete and certified is on you.
2. Accounts
To use the service you create an account. You agree to:
- Give us accurate information — your name, email, and carrier details — and keep it up to date.
- Keep your login credentials to yourself. You're responsible for what happens under your account.
- Only create or manage a fleet account if you're authorized to act for that carrier.
If we see an account being used to break these terms or the law, we can suspend or close it. If that ever happens to you and you think we got it wrong, email support and a human will look at it.
3. Subscription & billing
- Price. The service costs a flat $10 per truck per month. That's the whole platform — there are no per-feature charges on the core service. Optional add-ons (like dashcam hardware and monitoring) are priced separately and only if you order them.
- No contracts. Service is month to month. There are no minimum terms and no early-termination fees. You can cancel anytime; cancellation takes effect at the end of your current billing period, and you keep access until then.
- Hardware. The ELD device is a one-time purchase, currently $60 per device. A prepaid bundle (device plus twelve months of service) is available as posted on the pricing page.
- Refunds. Refund requests — for hardware or service — are handled through support@drayeld.com. Talk to us; we'd rather fix a problem than argue about one.
- Price changes. If we ever change pricing, we'll tell you in advance by email. Because there's no contract, you're free to cancel before a new price takes effect.
4. Acceptable use
Use the service honestly and lawfully. In particular, you agree not to:
- Falsify, alter or tamper with duty-status records, or use the service to help anyone else do so.
- Tamper with, disable or interfere with the device or the data it records.
- Copy, reverse engineer or resell the service or apps without a written agreement with us.
- Probe, overload or disrupt the service, or access another carrier's data without authorization.
- Share accounts or devices across trucks to avoid per-truck pricing.
5. Hardware terms
- It's yours. Once you've paid for a device, you own it. There's no lease and nothing to return if you cancel the subscription.
- Install it right. Install the device according to the included instructions (it plugs into the vehicle's diagnostic port). A mis-installed device can't record compliant data.
- Replacements. If a device is defective or stops working, contact support@drayeld.com and we'll arrange a replacement. Devices that have been opened, modified or physically damaged after delivery aren't covered.
- Don't modify it. Opening or altering the device can make its records unreliable — which is a compliance problem for you before it's a warranty problem for us.
6. Service availability
The service depends on things we don't fully control: cellular networks, GPS signals and third-party infrastructure. We work to keep the service reliable, but we can't and don't guarantee it will be uninterrupted or error-free, and we may occasionally take it down briefly for maintenance.
If your device or service malfunctions, follow the FMCSA's malfunction procedures: note the malfunction, keep paper records of duty status as required while it's unresolved, and get the device repaired or replaced within the required timeframe. Contact support immediately and we'll prioritize getting you back online. During a roadside inspection, follow the officer's instructions and FMCSA guidance for displaying or transferring records.
7. Intellectual property
The DRAYELD software, apps, website, design and trademarks belong to us. Your subscription gives you a limited, non-exclusive, non-transferable license to use them for operating your fleet — not to copy or resell them.
Your data is yours. The records your trucks and drivers generate belong to your operation. We host and process that data to run the service, as described in the privacy policy, and you can request a copy of it through support.
8. Limitation of liability
Plainly: we stand behind the product, but we can't insure your trucking operation.
- The service and device are provided "as is" to the maximum extent permitted by law.
- We are not liable for indirect or consequential damages — things like lost loads, lost profits or downtime.
- We are not responsible for fines, penalties or violations arising from how vehicles are operated or records are kept. Compliance decisions belong to the carrier and driver (see section 1).
- To the extent permitted by law, our total liability for any claim is capped at the amounts you paid us in the twelve months before the claim arose.
- Nothing in these terms limits liability that can't legally be limited.
9. Changes to these terms
We may update these terms from time to time. When we do, we'll update the date at the top of this page, and if a change is material we'll email the address on your account before it takes effect. Continuing to use the service after a change takes effect means you accept it; if you don't, you can cancel — there's no contract holding you.
